These general sales conditions define the rights and obligations between Andréa Beaud, sole trader – tourism consultant (SIRET 897 932 190 00019), hereinafter “Travel to the Azores”, on the one hand, and any natural or legal person purchasing services, hereinafter “the client”, on the other hand.
“Travel to the Azores” is the name given to the business created by Andréa Beaud. The services listed on the website www.voyage-aux-acores.com are offered by Andréa Beaud in her capacity as founder and manager of the business operating under the trade name “Voyage à Lisbonne – Voyage à Porto – Voyage aux Açores”. The business, registered in France, where Andréa Beaud carries out the activity of tourism consultant (NAF code 79.90Z), is registered with the Créteil Trade and Companies Register (R.C.S) under number 897 932 190. The client declares that they have taken note of all of these conditions and accept them without restriction or reservation.
The client is subject to the national law of their country of residence or of registration of their head office. Travel to the Azores is subject to French law. In the event of a conflict, the competent courts are the French courts. The client accepts these conditions without any reservation.
Travel to the Azores offers: consultancy on organising all or part of a trip; the negotiation of all or part of the services; the booking of services (car rental, accommodation, activities, dining); the provision of a personalised travel booklet and an interactive map. Travel to the Azores does not make any direct sale or any payment on behalf of its clients, who are solely responsible for payments to the providers.
The quote is drawn up on the basis of the information provided by the client and specifies the nature and price of the service, the payment terms, the description of the services and the schedule. Acceptance is given in writing (signed letter or clear and unambiguous e-mail). In the absence of written agreement and a deposit within the month following receipt of the quote, the proposal is deemed cancelled.
The price of the tourism consultancy service is stated on page 2 of the quote under the heading “fees”, expressed in euros including tax. It varies according to the number of people, the duration, the package and other considerations. The providers’ prices are indicative. The price cannot be changed after acceptance of the quote.
Andréa Beaud makes the bookings proposed in the quote. All sums requested by the providers are paid by the client directly and in full to each provider, whose identity and details are communicated to the client before any payment.
The quote is free. Upon acceptance, a deposit of thirty (30) % of the total amount is payable immediately, the contract being formed upon receipt of the agreement. The balance is payable no later than thirty (30) days before the trip. Fees are paid by bank transfer; a detailed invoice is provided.
Any delay results in the immediate payability of the sums due, a late-payment penalty at a rate of three (3) times the legal interest rate, the right to suspend the service and to bring any necessary proceedings.
The duration is set out in the quote or the letter of engagement. In the event of cancellation by the client: up to 30 days before arrival, 30 % is due (the deposit); from 30 days, 100 % is due. In the event of cancellation by Travel to the Azores (other than force majeure), all sums paid in respect of its service are refunded, without compensation.
Neither party may be considered in default if the obligation is affected by an event of force majeure (art. 1218 of the French Civil Code): natural disasters, government restrictions, wars, casualties, accidents. Notification by registered letter within 5 working days. Beyond 15 days, either party may terminate without damages.
If government health measures prevent the trip from taking place without fault on the part of the client, Travel to the Azores issues a voucher valid until 31 December of the year following the cancellation, for the same number of people and days, and informs the client of the providers’ cancellation conditions.
Travel to the Azores undertakes to maintain the strictest confidentiality, to disclose no information about the services provided, to return any document supplied and to sign a confidentiality agreement on request. The client undertakes to respect the dates and times of the services.
Travel to the Azores acts as a travel consultant and is bound only by an obligation of means. Its liability, if proven, is limited to half of the sum actually paid for the service concerned. The services include no insurance: it is recommended (and mandatory for business trips) to take out travel insurance. The client is solely responsible for any personal injury suffered and must comply with the instructions of the government of the Azores.
The client may assign their booking to a third party, who inherits the rights and obligations. The client and the third party are jointly and severally liable. Substantial changes (dates, number of participants) are treated as a cancellation followed by a new booking.
The client has a right of withdrawal of 14 working days after firm and final acceptance of the quote.
The trademarks, domain names, software, images, videos and texts remain the exclusive property of Travel to the Azores. No assignment is made through these conditions. Any reproduction, in whole or in part, is strictly prohibited.
